The full text of the "Employees' Annual Leave Rule" is published

BEIJING, December 16th, the 198th executive meeting of the State Council of China on December 7th has passed the "Regulations on paid annual leave for employees." The regulations will come into force on January 1, 2008.
The following is the full text of the "Regulations on the Annual Leave of Staff and Workers" announced by the Chinese Government Network today.
Article 1 of the Regulations on the Annual Leave of Workers with Pay is to revive the rights of employees to take rest and to mobilize the enthusiasm of employees, and to enact these Regulations in accordance with the Labor Law and the Civil Service Law.
Article 2 The employees of institutions, organizations, enterprises, institutions, private non-enterprise units, and individual industrial and commercial households with employees who have worked for more than one year shall enjoy paid annual leave (hereinafter referred to as annual leave). The unit shall ensure that employees enjoy annual leave. Employees enjoy the same salary income as during normal working hours during the annual leave.
Article 3 If the accumulated work of an employee has been less than 10 years and less than 10 years, the annual leave is 5 days; if the employee has reached 10 years and less than 20 years, the annual leave is 10 days; if the employee has reached 20 years, the annual leave is 15 days.
National statutory holidays and rest days are not counted as holidays for annual vacations.
Article 4 If an employee has one of the following circumstances, he or she shall not enjoy the annual leave of the year:
(1) Employees enjoy winter and summer vacations according to law, and their vacation days are more than the number of days of vacation;
(2) The employee has requested leave for more than 20 days and the unit does not deduct wages according to the regulations;
(3) Employees who have worked for one year and less than 10 years, and have accumulated sick leave for more than 2 months;
(4) Employees who have worked for 10 years or less and less than 20 years of work, and have accumulated sick leave for more than 3 months;
(5) For employees who have worked for more than 20 years, please have sick leave for more than 4 months.
Article 5 Units shall make overall arrangements for the annual leave of employees according to the specific conditions of production and work, and taking into account the wishes of the employees themselves.
Annual leave can be arranged centrally in one year, or can be arranged in sections, generally not across annual arrangements. Due to the characteristics of production and work, it is necessary to arrange annual leave for employees across the year, which can be arranged across one year.
If the unit is unable to arrange for the employee to take annual leave due to work needs, the employee may not arrange for the employee to take annual leave with the consent of the employee. For the number of days of annual leave for employees to be closed, the unit shall pay annual vacation wages in accordance with 300% of the employee's daily wage income.
Article 6 The personnel department and labor security department of the local people's government at or above the county level shall take the initiative to supervise and inspect the implementation of these Regulations in accordance with their functions and powers.
Trade union organizations protect the rights of employees' annual leave in accordance with the law.
Article 7 The unit does not arrange for employees to take annual leave and not to pay annual leave in accordance with the provisions of these Regulations. 9 7 3 12 4 8 :
